Terms of Service & Disclaimer
These Terms of Service ("Terms") govern your access to and use of the FileForge website, application and file-generation tool (together, the "Service"), operated by Logos Risk & Analytics (Pty) Ltd (registration no. 2026/387027/07) ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What FileForge is
FileForge generates draft occupational health & safety documentation using artificial intelligence, based on professional templates and the requirements of the Occupational Health and Safety Act 85 of 1993 and related regulations. The Service is a document-preparation tool. It is not a safety consultancy, and using it does not engage us to provide safety, legal or professional services to you.
2. Draft documents and the competent-person requirement
Every file the Service produces is a draft. Before you use, submit, display or rely on any file, you must:
- review the entire document for accuracy and completeness;
- adapt it to your specific site, activity, equipment and organisation;
- verify that it reflects the legal requirements that actually apply to you; and
- have it reviewed and signed off by a competent person as contemplated in the applicable legislation.
AI-generated content can be incomplete, out of date or incorrect. We do not warrant that any file is accurate, complete, current or fit for your particular purpose.
3. No advisory relationship
Generating a file does not create any consulting, advisory, professional or client relationship between you and us, and no individual file is reviewed, approved or signed off by us on your behalf. Any guidance, templates or examples provided through the Service are general in nature and are not a substitute for professional advice obtained for your specific circumstances.
4. Your responsibilities
- You are solely responsible for the accuracy, completeness, legal compliance and suitability of any file you generate, edit, export or use.
- You are responsible for the information you enter into the Service and for ensuring you are entitled to use it.
- You must comply with all laws applicable to your operations, including your health-and-safety obligations as an employer or duty-holder.
5. Accounts and credits
Some features require an account and the use of credits. A credit is consumed when a file is generated. Credits and pricing are described in the Service and may change. You are responsible for keeping your login details secure and for activity that occurs under your account.
6. Acceptable use
You agree not to misuse the Service, including by attempting to disrupt it, access it without authorisation, resell or redistribute generated files as a competing file-generation service, or use it for any unlawful purpose.
7. Data and privacy (POPIA)
To provide the Service we store the information you enter, the files you generate and any signature images you upload. This may include personal information, which we process in line with the Protection of Personal Information Act 4 of 2013 (POPIA). Our roles. For personal information about you, the account holder (such as your name, contact and billing details), we are the responsible party. For personal information you enter about other people — including your workforce, appointees and anyone named in a safety file or on-site check (“Workforce Data”) — you are the responsible party and we act as your operator: we process Workforce Data only on your instructions and only to provide the Service to you, not for our own purposes. We maintain reasonable technical and organisational safeguards over Workforce Data and will, so far as reasonable, assist you to respond to requests from the individuals concerned and to meet your obligations towards them.
Your permission to use other people’s information. You warrant that, for all Workforce Data and any other third-party personal information you enter into the Service, you have a lawful basis under POPIA to do so, and that you have given any notices to, and obtained any consents or permissions from, the individuals concerned that POPIA requires for their information to be used to generate safety documentation and to run on-site safety checks. You are responsible for the accuracy of that information. You must not enter special personal information (such as identity numbers) or the personal information of children unless you are lawfully entitled to do so and it is necessary for the Service.
On-site (Field) checks. When you use the on-site features, you may be asked to confirm a specific, recorded warranty that the affected workforce have been informed and that any required permission has been obtained before a foreman link is created. That confirmation is in addition to, and does not replace, the warranty above.
8. Limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind. To the extent permitted by law, we will not be liable for any loss, damage, claim, fine, penalty or injury arising out of or in connection with your use of the Service or any file produced by it, including any file that is inaccurate, incomplete or unsuitable. Nothing in these Terms limits any liability that cannot lawfully be limited.
9. Indemnity
You agree to indemnify and hold us harmless against any claim, loss, fine, penalty or expense arising from your use of the Service or any file you generate, edit or rely on, or from any breach of your warranties in section 7 — including entering another person’s personal information without a lawful basis or the permission POPIA requires — to the extent permitted by law.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "last updated" date above, and your continued use of the Service after a change means you accept the updated Terms.
